On October 21, the Legal Committee held its in-person seminar:

“Artificial Intelligence and Business Law: Legal Challenges in the Digital Era”

The event brought together experts to discuss the main impacts of AI in the corporate environment, covering topics ranging from criminal risks associated with deepfakes and digital fraud to intellectual property dilemmas arising from the rise of generative artificial intelligence. It also explored challenges related to personal data protection, considering regulatory innovations in Brazil and abroad, as well as practical strategies for prevention, governance, and risk mitigation. A unique opportunity to understand how to align technological innovation, legal security, and the protection of fundamental rights in a constantly evolving landscape.

 

Synopses and Speakers

Generative AI and the New Frontier of Intellectual Property: Risks and Opportunities in the Corporate Environment

The presentation will address the growing impact of Generative Artificial Intelligence from an Intellectual Property perspective, focusing on the challenges and opportunities for companies operating in a global environment. The analysis will focus on the “double challenge” that AI poses: on the one hand, the legal dilemma of ‘inputs’ (the use of protected material for training models), contrasting the approaches in the US, European Union, and Brazil; on the other hand, the paradox of “outputs” (the complex protection of creations generated by AI). Finally, corporate strategies for risk mitigation will be discussed.

 

Luiz Henrique Souza
Senior lawyer in the Civil Law department at Gaia Silva Gaede Advogados’ São Paulo office. He focuses on corporate law, business contracts, technology, and innovation. Luiz serves clients from various sectors of the economy, including manufacturing, pharmaceuticals, agribusiness, payment methods, technology, and startups.

 

AI and personal data protection: challenges and developments
We will discuss how artificial intelligence is transforming the processing of personal information and the main risks of transparency, re-identification, and accountability. We will discuss regulatory innovations in Brazil and abroad, the role of the ANPD, and strategies such as privacy by design and algorithm auditing. An invitation to reflect on how to balance technological innovation and the protection of fundamental rights.

 

Felipe de Araujo Monteiro
With a law degree from PUC-SP and a degree in International Relations (with an emphasis on Marketing and Business) from ESPM, he is a leader in the areas of business contracts, intellectual property, and technology transfer, advising companies in sectors such as finance, healthcare, biotechnology, and regulatory innovation. As a lawyer, he combines advisory experience and international business acumen, developed throughout his career in projects ranging from corporate transactions to global technology licensing. He also works in regulatory compliance and data protection, helping companies align innovation and governance in highly regulated environments. Currently, in addition to being a master’s student in law and assistant professor at PUC-SP, he is a partner, lawyer, and head of the business contracts area at Kasznar Leonardos.

 

Deepfakes and Digital Fraud: New Criminal Challenges for Businesses
The lecture will address how deepfakes and digital fraud are being used in sophisticated scams against companies, from cloning executives’ voices to forging electronic documents. Practical examples will be presented, along with the main criminal risks that can affect the corporate environment and prevention and protection strategies in this new technological landscape.
